The Jimquisition: When Jim Sterling Was Sued For $10 Million By Digital Homicide

http://www.patreon.com/jimquisition

I am the videogame critic they tried to sue for $10 million.

I’ve kept relatively quiet for almost a year while a spurious and disgusting libel lawsuit was spuriously filed in an attempt to disrupt my life.

Now I get to talk.

Obviously Jim’s talked about everything, and probably just wants to move on. But I can’t see the dismissal as anything other than a pyrrhic victory. Jim still had to eat the cost of hs lawyer, and dismissal means that Jim doesn’t have to deal with this particular case or this particular wanker, but future devs might be just as audacious, or stupid, or insane. I wish James Romine had a little money so it was worth Jim taking it all the way to court. Because a real verdict smacking down James Romine sets a much needed precedent which makes it… Read more »

Good thing that you are not taking any further actions against DH, they had enough, internet will take care of the corpse remainings. Besides, my #1 Kissboy needs a rest anyway.

Glad I got up early so I had time to watch this before work, i’m with you Jim, I don’t blame you for not wanting to waste your efforts on the Romine bros, they are far too pathetic to waste time on. Though I don’t agree with Konami being worse then DH, at the very least Konami aren’t dumb enough to try and personally sue people for criticizing them.

Friends make everything better. It’s the lazy man’s content, moreso than endless filler in an Ubisandbox, and it’s why we have to pay for online services (because they know we will pay just to play with friends instead of choosing to not play at all).

Salador

Konami could try it, though. They’ll have lawyers, for one, which will mean that cases will be filed competently and won’t be dismissed for being incoherent nonsense.

diamond
Guest

Don’t be so sure, they know nothing about U.S. law given their attempts at taking down Youtube videos, in general many game companies in Japan seem very ignorant on U.S. law. as evidenced by Nintendo’s dumbfuckery when it comes to taking down videos for no good reason.

Salador
Guest
Salador

But the mere fact that they have resources and professionals means that they’re actually far more of a threat than Romine etc. could ever be.

Which is why nobody has taken Nintendo to court. Because, with the justice league of lawyers that Nintendo can assemble, they could sneak a victory even though they’re wrong, and, even if they don’t, the lawsuit would be a long and stressful thing for the youtuber in question, but it wouldn’t even be an item on the agenda of Nintendo’s executives.

I’m not worried about Konami, they’re too worried about bad publicity to try anything that dumb.

If anyone may have some kind of grounds, it would be Nintendo. After the past Jimquisition video, they may take legal actions for advocating illegal actions (which under certain circumstances is not protected under the first amendment). But first they would have to give a crap about what Jim says.

Except he didn’t actually advocate illegal actions, he said many times throughout “don’t actually do this”.

Awesome stuff, Jim, and I did laugh a couple of times.

Having a threat hanging over you, even one as ridiculous as this one, is exhausting.

When it’s cleared that is a good feeling, though. Me, I’d meet up with some friends and get fucking wrecked on whatever I could get my hands on. Not sure if that’s your bag but you ought to have a treat, it reinforces why it’s worth fighting these kind of things.

Damn it. Now I just want to go out and get wrecked myself.

Oh, as a side note to those scumsnakes that threatened to KEEP suing Jim in some Force-Choke bullshit effort to drive Jim Sterling out of business, I suggest you go to Wikpedia, and look up two phrases. Frivolous Lawsuits, and Vexatious Lawsuits, EACH of which can impose CONSIDERABLE penalties on the part of the people doing the filing, especially when they file pro se as Romine did. I sure do hope you enjoy playing lawyer, when a Judge slaps you with a $10,000 fine, in ADDITION to all your other penalties, AND paying for Jim’s high priced lawyer. I stand… Read more »

BMC likes Digital Homicide enough to have subtle and explicit references to them in their home videos-turned-games. They have never tried anything, but they can’t be the only ones who see DH as a role model to be aspired to.

Daniel Jensen

BMC is basically Digital Homicide with the ego problems: They make what’s essentially hobbyist-level games, they refuse to make better products because they don’t see the point in putting in more effort, and they also ignore criticism. The difference is that they’re just having fun and don’t really give a shit what anyone thinks of them. Whether that excuses the fact that they’re essentially making “Doing it for the giggles” GameGuru crap on Steam is open to debate, of course. Anyway, the two studios probably saw each other as kindred spirits, what with the fact that they both make sub-par… Read more »

“Whether that excuses the fact that they’re essentially making “Doing it for the giggles” GameGuru crap on Steam is open to debate, of course.”

It doesn’t excuse that at all seeing as they’re still charging money for that rubbish. It just means they aren’t as fucked in the head as James Romine.

It’s also worth pointing out the best way to get a frivolous suit thrown out is to provide evidence… Say, a Youtube comment… of the plaintiff admitting that they just want to cause you stress and/or bleed you dry.

The only slight calibration I would have made would have been to replace “legally protected right” to “my rights under the U.S. Constitution”. I suppose I can forgive it though as since you are an immigrant to this nation you may not understand how strong that argument is in the United States of America.

Fallen Prime

A. I don’t think the Constitution has anything on vidya gains. Free speech, certainly, it’s in the Bill of Rights, but not vidya gains.

B. “AMERICA!” doesn’t work as a trump card for everyone, against everyone.

Ces

Legally protected right and rights under the US Constitution just mean the same thing though, except legally protected doesn’t exclude everywhere that’s not the States. Jim works on the internet: I would actually argue not limiting it to America is a lot stronger because, well, shitty devs are an international phenomenon. And btw, we non-Americans are pretty aware of how much you love your Constitution. 😉

The Romines being most assuredly petty, I’m pretty sure ol’ James watched the vid and just spent forty minutes gnashing his teeth, trying to frame this as another attempt at defamation. Only now he’ll ask for eleventy billion simoleons, because Jim’s established that in Romine’s world, critiquing his work is on par with stealing his car, locking his wife in there, dousing the thing with gasoline and lighting it up. I used to think I didn’t have the thickest skin out there, but I guess this mess more or less reassured me. It’s apparently possible to take honest criticism as… Read more »

“Not being able to do anything” and “Still seeing it that way” are not mutually exclusive.

Also, he can’t bring up the same charges. A man as petty as that, provided they magically acquired resources, could manufacture new charges in much the same fashion as they manufactured the original charges.

I gathered that from the Leonard French videos and livestream, where he just shows the documents in full as he read them. It was the kind of legal speak I would write in a story or game, not the kind that an actual lawyer who knew actual law would write.

I’m pretty sure Romine’s definition of “vindictive legal action” conveniently doesn’t include striking back at Jim.

Ten to one he’ll be held in contempt of court in some other case, with another defendant. Sterling’s off the hook, but there’s other fish in the sea.

I lost it when Romine started to try and frame Jim as being irrelevant to the industry, only to lose his train of thought. If you’re going to head up against someone in a debate, maybe consider preparing yourself in advance. Stick to your arguments, and don’t try and spin a Catch-22 out of your ass. Yeah, Robert was the one telling Jim to look up what a leech was and making statements like “If there were no video games, there’s be no video game critics!”. James just sat there occasionally handing Robert documents, and I would have thought it was one-on-one if Jim hadn’t come out and said “Oh, hey, there was quiet guy there too.”

Although I admit, I keep picturing the lawsuit drivel coming from the same guy as the “interview” for that reason (as well as the similar degrees of cognitive faculties)

Also, wow…that game clip in the middle of the video of his you put text over, I had never seen that before. Is that all it is? Having grown up around various forms of domestic violence and shiz, that stuff hardly surprises or offends me, especially when it resembles more like a lonely guy’s role playing with a sex doll covered in red paint packs…but it just makes me feel pretty sad for the creator’s state of mind when they think that’s a good thing they made. It was one of the few instances of them taking something down voluntarily as well. And then at some point, they decided they would just spontaneously add and delete games from their Greenlight submissions (including Suzie’s) whenever the down-votes got too high and that carried on until they felt the best idea was to just dump EVERYTHING on Greenlight.
